Article 2 - Applicability
These general terms and conditions apply to every offer from Het Koffiepaleis V.O.F. and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be inspected at the entrepreneur's premises and they will be sent free of charge to the consumer as soon as possible upon request.
If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier.
Article 3 - The offer
If an offer has a limited validity period or is made under certain conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.
The assortment of Het Koffiepaleis V.O.F. includes, among others:
- Coffee beans and ground coffee
- Coffee machines and equipment
- Accessories (filters, cups, etc.)
- Coffee capsules and pods
- Tea
Article 4 - The agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set forth therein.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can dissolve the agreement.
The entrepreneur reserves the right not to accept orders or assignments without stating reasons, or to set additional conditions for their execution.
Article 5 - Right of withdrawal
5.1 Cooling-off period
The consumer can dissolve an agreement regarding the purchase of a product during a cooling-off period of at least 14 days without stating reasons. The entrepreneur may ask the consumer about the reason for withdrawal, but the consumer is not obliged to provide it.
The cooling-off period mentioned in the first paragraph commences on the day after the consumer, or a third party designated by the consumer in advance, who is not the carrier, has received the product, or:
- If the consumer has ordered multiple products in the same order: the day on which the consumer, or a third party designated by him, received the last product.
- If the delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by him, received the last shipment or the last part.
5.2 Products excluded from the right of withdrawal
The right of withdrawal does not apply to:
- Products that can spoil quickly or have a limited shelf life.
- Sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.
5.3 Exercise of the right of withdrawal
The consumer who wishes to exercise the right of withdrawal must notify this within the cooling-off period by means of an unambiguous declaration by e-mail to info@hetkoffiepaleis.nl.
The consumer must return the product or hand it over to the entrepreneur as soon as possible, but in any case within 14 days from the day following the notification of withdrawal. The consumer has in any case complied with the return period if he returns the product before the cooling-off period has expired.
Article 6 - Costs in case of withdrawal
If the consumer exercises his right of withdrawal, the costs of return will be borne by the consumer, unless the product is defective, damaged or incorrectly delivered. In that case, the return costs will be reimbursed by Het Koffiepaleis V.O.F.
If the consumer withdraws, the entrepreneur will refund all payments made by the consumer, including the original delivery costs, as soon as possible, but in any case within 14 days after the day on which the entrepreneur receives the withdrawal.
For reimbursement, the entrepreneur will use the same payment method that the consumer used, unless the consumer agrees to another method. The reimbursement is free of charge for the consumer.
If the consumer has chosen a more expensive method of delivery than the cheapest standard delivery, the entrepreneur does not have to reimburse the additional costs for the more expensive method.
Article 7 - Delivery and execution
The entrepreneur will exercise the greatest possible care when receiving and executing product orders.
The place of delivery is the address that the consumer has made known to the entrepreneur.
The usual delivery time is 1 to 2 working days after confirmation of the order, provided the product is in stock. In exceptional cases or during busy periods, the delivery time may be longer; the consumer will be informed of this as soon as possible.
The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a representative designated in advance and made known to the entrepreneur, unless expressly agreed otherwise.
Article 8 - Shipping costs
Shipping costs are clearly stated when checking out the order.
Orders with an order value of €50.00 or more will be shipped free of charge within the Netherlands.
For orders under €50.00, the applicable shipping costs will be charged, as displayed in the webshop at the time of ordering.
Article 9 - Payment
The consumer can pay for the order via the following payment methods:
- iDEAL
- Pay later via Klarna
- Gift card / voucher from Het Koffiepaleis
Unless otherwise agreed, the amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period, or in the absence of a cooling-off period, within 14 days after the conclusion of the agreement.
When paying afterwards via Klarna, Klarna's terms and conditions apply. The consumer explicitly agrees to this when using this payment method.
In case of late payment, the consumer is legally in default. From that moment on, statutory interest is due. The entrepreneur also has the right to charge reasonable collection costs.
Article 10 - Warranty
10.1 Equipment and machines
The statutory conformity guarantee applies to coffee machines and other equipment in accordance with Book 7 of the Dutch Civil Code. This means that the product has the properties that the consumer can expect on the basis of the agreement.
Additional factory warranty varies per product and brand. The applicable warranty period and conditions are stated on the product page or can be found in the documentation accompanying the product. In case of doubt, the consumer can contact info@hetkoffiepaleis.nl.
10.2 Consumables (coffee, tea, capsules, accessories)
For consumables, only the legal right to complain applies in the event of a demonstrable defect or non-conformity. This includes, for example, incorrect delivery, damaged packaging or a product that demonstrably does not comply with the description.
Complaints about consumables must be reported as soon as possible - and no later than 2 months after discovery - via info@hetkoffiepaleis.nl, stating the order number and a description of the problem.
Article 11 - Complaints procedure
The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
Complaints about the implementation of the agreement must be submitted to the entrepreneur via info@hetkoffiepaleis.nl, fully and clearly described, within a reasonable time after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will reply within the 14-day period with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.
Article 12 - Disputes
Agreements between the entrepreneur and the consumer to which these general terms and conditions relate are exclusively governed by Dutch law.
Disputes between the consumer and the entrepreneur about the conclusion or execution of agreements regarding products and services to be delivered or delivered by this entrepreneur, can be submitted by both the consumer and the entrepreneur to the competent court.
In addition, the consumer has the option to submit a dispute to the Disputes Committee via the European Commission's ODR platform: https://ec.europa.eu/consumers/odr.
Article 13 - Privacy and personal data
The entrepreneur processes personal data of the consumer in accordance with the General Data Protection Regulation (GDPR) and the GDPR Implementation Act. The way in which personal data is processed is described in the privacy statement of Het Koffiepaleis, which can be consulted on the website.
Personal data is used exclusively for the execution of the agreement, the processing of orders and - if the consumer has given permission for this - for marketing purposes.
Article 14 - Amendment of general terms and conditions
Het Koffiepaleis V.O.F. reserves the right to amend or supplement these general terms and conditions. Amendments also apply to agreements already concluded. Amendments will be announced 30 days before they take effect via the website.
If the consumer does not wish to accept an amendment, he can terminate the agreement with effect from the date on which the new general terms and conditions come into force.
